Hereinafter the service provider Tyler Skrobacz and or his/her contractors, employees, or any authorized persons, shall be referred to as “Tyler Skrobacz | Cinematographer & Mobile DJ”.

 

Refunds

Tyler Skrobacz | Cinematographer & Mobile DJ is under no obligation to provide any refund. However, if under acts of god, Tyler Skrobacz | Cinematographer & Mobile DJ is unable to safely and/or perform your service Tyler Skrobacz | Cinematographer & Mobile DJ will refund your service up to 10 (ten) business days after your service date. No completed or past completed services will be eligible for refunds. All Content Created including but not limited to flash drives, video content, photography content, and digital downloads are not eligible for refunds.

Unknown Illnesses

Tyler Skrobacz | Cinematographer & Mobile DJ cannot guarantee that all equipment or locations will be sanitized or cleaned frequently, it is the responsibility of CLIENT and venue to follow CDC and local government guidelines. CLIENT Waives all rights to hold Tyler Skrobacz | Cinematographer & Mobile DJ liable for any reason including but not limited to, heath related reasons during or after the service being provided.

 

Invoices

After A Quote is Generated from Our Website at https://www.tylerskrobacz.com/ we will attempt to email you and once the quote has been accepted, we will generate an invoice. All Invoices will have a “Pay by” or “Payment Due By” date. CLIENT is to pay the full amount (including any deposit fees or additional charges).

Music Release

Any music or content given to Tyler Skrobacz | Cinematographer & Mobile DJ; allows Tyler Skrobacz | Cinematographer & Mobile DJ to copy, edit, reuse, or remove content as needed. Tyler Skrobacz | Cinematographer & Mobile DJ retains the right to use the content for future videos, music or other content not necessarily related to this service. All Content submitted to Tyler Skrobacz | Cinematographer & Mobile DJ shall be free of any royalty and legal issues and only original music that is permitted by CLIENT and the original artist shall be used. Tyler Skrobacz | Cinematographer & Mobile DJ and his or her designees has the right to request written permission to use music or audio in film, content, or production.

Service Tracker

Online Service Tracker may be used to download your final completed project. When Service is completed, you will receive further instructions to download from our website. Client Understands that Tyler Skrobacz | Cinematographer & Mobile DJ cannot claim that the website will work on all devices. CLIENT shall be responsible for securing any passwords or documents provided and not by sharing sensitive information to other ill-intent parties.

Model Release

CLIENT grant’s us the unrestricted right to be videotaping, playing music, taking photographs, recording, or capturing CLIENT’s event guests, public guests, event staff, venue staff, or anyone in attendance; and to publish without restriction to use, re-use and re-publish of the videos or content captured during CLIENT’s service in any medium now or hereinafter known and for any purpose, whatsoever but not limited to; including illustration, promotion, advertising, and trade.

 

Video & Photo Edits

Additional edits can be performed as on a case-by case basis and may cost more depending on the project needed. Tyler Skrobacz | Cinematographer & Mobile DJ has the right to refuse additional edits and may choose to charge more for additional edits as needed.

 

Logo Release

If CLIENT gives us a corporate or business logo, they give us the legal right to use it on any content captured, created, or given by Tyler Skrobacz | Cinematographer & Mobile DJ. CLIENT and any company related; team and any attendees waive all rights for illegally or illicitly using CLIENT’s logo or business name. CLIENT takes full responsibility to ensure that he or she is authorized to use the logo on any content or service Tyler Skrobacz, Cinematographer & Mobile DJ Creates or provides.

 

Copyright & Use

Tyler Skrobacz | Cinematographer & Mobile DJ retains the full rights to the photographs, videos or any content taken during this service or event. CLIENT may only use the content taken for the purpose of this contract: Non-Profit Event Walk & Website/Facebook Advertizing;  and may not re-use, re-edit, or re-upload to any additional sites, including internet locations or physical locations without written permission by Tyler Skrobacz Cinematographer & Mobile DJ.  CLIENT may not hire an additional party to edit the footage or content Tyler Skrobacz Cinematographer & Mobile DJ has already produced without written permission.

 

Safety

Tyler Skrobacz | Cinematographer & Mobile DJ take’s safety very seriously; CLIENT should ensure that Tyler Skrobacz and his/her designees have a safe working area(s). CLIENT takes full responsibility of the event guests, venue staff, landlord and any parties or public guests in attendance, CLIENT waives all rights to sue or hold Tyler Skrobacz, Cinematographer & Mobile DJ liable for any damages and shall be solely responsible for the service being provided. We hold the right to determine wither a service can be safely performed at a location. No refunds will be given for unsafe working environments.

Authorization of Locations

CLIENT gives us legal permission to be at the following address and locations and shall be responsible for obtaining necessary permits, licenses and other fees that may apply. In the event a gate code/access code is given, Tyler Skrobacz | Cinematographer & Mobile DJ are not responsible for any misuse or abuse by CLIENT, event guest or other parties in attendance including venue staff or delegates.

Damages

CLIENT agree’ s to pay for all damages to Tyler Skrobacz | Cinematographer & Mobile DJ equipment caused by the negligence of CLIENT or any of the attendees. It is hereby further agreed; that CLIENT shall be held liable for any injury or damages to Tyler Skrobacz | Cinematographer & Mobile DJ, or property of Tyler Skrobacz Cinematographer & Mobile DJ, while on the premises of said engagement, if damages is caused by CLIENT, members of his/her organization, engagement invitees, employees, or any other party in attendance.

 

Location/Property Release

CLIENT gives us express permission to capture event location or event locations in detail. Tyler Skrobacz | Cinematographer & Mobile DJ may take video, photographs, play copyrighted music or capture other content not listed in this contract including but not limited to locations, properties, persons, assets, or vehicles. CLIENT will obtain all necessary permits, licenses, and other legal documents for us to perform the services requested. CLIENT waives all rights to hold liable for any expectation of privacy and any misrepresentation for the services being provided or content created from location.

Additional Terms & Notice

For Outdoor Public Locations In Florida There is No Expectations of Privacy in Public. Tyler Skrobacz, Cinematographer & Mobile DJ can, will and shall take pictures, content, videos, and other content not necessarily related to this contract at will without needing appropriate signatures, legal documents or other government or local approvals. CLIENT Understands this as part of this service contract & agreements.

 

Entire Agreement

By Signing, CLIENT Agrees to this entire contract listed above. CLIENT agrees that this contract is legally binding in the State of Florida, United States of America. CLIENT waives all rights to sue, hold Tyler Skrobacz | Cinematographer & Mobile DJ, his/or her contractors, designees, or employees of any damages; both physical and mental. CLIENT Understands that this document may not be re-written or changed without permission by Tyler Skrobacz, Cinematographer | Mobile DJ
